In writing about the web domain company EasyDNS’ online pharmacy policy, Mike Masnick, founder of award-winning technology and business innovation blog Techdirt, makes the following observation:
“Fake and dangerous drugs from rogue pharmacies are a real (if relatively small) problem. Legitimate foreign pharmacies selling into the US at cheaper prices are a made up problem by US drug companies. But those US drug companies like to take the “small” problem, and blame it on any non-US pharmacy in an attempt to block out the competition.”
Thank you Mike for expressing that so clearly! The essence of TechDirt is to “analyze and offer insight into news stories about changes in government policy, technology and legal issues that affect companies’ ability to innovate and grow.” Innovation via the Internet has allowed consumers who can’t afford their medicine domestically to access it through foreign pharmacies. The pharmaceutical industry and its well-funded agents are getting away with murder by pressuring online “gatekeepers” such as domain registrars, search engines, and credit card companies to disallow service to pharmacies that American consumers have come to rely on.
To some in the public health community and in government, Mike’s expression of rogue online pharmacies as a “relatively small” problem” may come across as flippant and even naïve – but it cuts much deeper than that. The question is relative to what? If he means relative to the public health crisis of high drug prices in America then Mike is entirely correct: rogue online pharmacies are a small problem compared to high drug prices in America. Far more Americans are getting sick and/or dying because they can’t afford medication at home than they are from dangerous online pharmacy purchases.
That does not excuse the actions of rogue pharmacy websites that endanger the health of consumers. That’s precisely why EasyDNS’ decision to only provide service to online pharmacies if they are approved by LegitScript or PharmacyChecker is visionary. It does not let dangerous pharmacy websites exist, but it refuses to succumb to a protectionist, anti-consumer, big pharma initiative to snuff out innovative business models – safe international online pharmacy – that hinder their profit-making machine and grossly disadvantage consumers.

The dangers of “rogue” international online pharmacies that sell fake or substandard medication go beyond just those affecting your health. Rogues are also known for playing loose with your personal information, including fraudulently charging your credit card or even selling the information to other scammers.
The DEA has issued a press release warning about criminals impersonating DEA special agents in an attempt to extort Americans who may have purchased medication from disreputable websites. The scammers, posing as DEA agents, call consumers and inform them that they have committed a crime in their online or telephone purchase of pharmaceuticals, sometimes citing illegal drug importation. The scammer then insists that the consumer pay a “fine” or face criminal prosecution. The reality is that DEA agents will never personally call a person to demand any form of payment. If you receive one of these bogus calls just refuse their demand and report the rogue activity to the DEA.
Keep in mind that the DEA is primarily concerned with controlled substances, such as Ambien and Oxycontin. Any penalties for ordering non-controlled medication would be served by the FDA and the FDA has never prosecuted or fined an individual for personally importing medications.
This scam is nothing new, and is a reminder that Americans looking to purchase medication from international online pharmacies should be aware of the difference between a potentially dangerous pharmacy and a legitimate one. Senator Charles Schumer (D-NY) is calling for a crackdown on rogue online pharmacies to curtail prescription drug abuse. Senator Schumer’s emphasis is on stopping online pharmacies that sell drugs without a prescription, particularly addictive drugs, such as Adderall and Xanax, which are controlled substances. We commend Senator Schumer on his actions. Since we first began our own work in 2002, a key requirement for an online pharmacy to be approved in the PharmacyChecker.com Verification Program has been that it require a valid U.S. prescription before dispensing any drug to an American. We also require that any pharmacy selling controlled substances to Americans be based in the U.S. and comply with the Ryan Haight Online Pharmacy Consumer Protection Act of 2008 – legislation intended to curb drug abuse.
This is not Senator Schumer’s first call to arms regarding online pharmacies. In 2006, he co-sponsored the Internet Pharmacy Consumer Protection Act (S. 399), a bill to curb the sale of prescription drugs over the Internet without a valid prescription. A press release from Schumer’s office noted, “the bill is geared to domestic Internet pharmacies that sell drugs without a valid prescription, not international pharmacies that sell drugs at a low cost to individuals who have a valid prescription from their U.S. doctors.” Unfortunately, S. 399 never became law.
